Warranty. HP warrants the physical media on which the Software is supplied against defects in materials and workmanship for 90 calendar days from the date the Software is shipped to you. During the same 90 calendar day period specified above, HP warrants that the Software will conform to written specifications and will not fail to execute its programming instructions due to defects in material and workmanship when properly installed and used on the device(s) specified by HP.

If HP receives written notice of defects or non-conformance to written specifications or failure to execute its programming instructions during the warranty period, HP will, at HP’s sole option and as your sole remedy against HP, repair or replace the affected Software. If HP is unable, within a reasonable time, to repair, replace or correct a defect or non-conformance in Software to a condition as warranted, you will be entitled to a refund of the purchase price upon prompt return of the Software to HP. You will be responsible for paying expenses for return of such Software to HP.

HP does not warrant that the operation of Software will be uninterrupted or error free.

HP does not warrant that Software will operate in hardware and software combinations selected by you or any third party, or meet your requirements.

HP reserves the right to change the warranty. The warranty period begins on the date of delivery, or the date of installation if installed by HP.

The above warranties do not apply to defects resulting from improper or inadequate maintenance by you; your or any third party supplied software, interfacing or supplies; unauthorized modification; improper use or operation outside of the specifications for the software; abuse, negligence, accident, loss or damage in transit; improper site preparation; unauthorized maintenance or repair; or defects or bugs in the Bundled Products.

TO THE EXTENT ALLOWED BY LOCAL LAW, THE ABOVE WARRANTIES ARE EXCLUSIVE. NO OTHER WARRANTY OR CONDITION, WHETHER WRITTEN OR ORAL, IS EXPRESSED OR IMPLIED AND HP SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NONINFRINGEMENT. Some countries, states or provinces do not allow limitations on the duration of an implied warranty, so the above limitation or exclusion might not apply to you. This warranty gives you specific legal rights and you might also have other rights that vary from country to country, state to state, or province to province.

TO THE EXTENT ALLOWED BY LOCAL LAW, THE REMEDIES IN THIS WARRANTY STATEMENT ARE YOUR SOLE AND EXCLUSIVE REMEDIES. EXCEPT AS SPECIFIED ABOVE, IN NO EVENT WILL HP OR ITS SUPPLIERS BE LIABLE FOR BUSINESS INTERRUPTIONS ARISING FROM USE OF THE SOFTWARE OR FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOST PROFIT OR DATA), OR OTHER DAMAGE, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, WHETHER OR NOT HP HAS BEEN ADVISED OF THE SAME.
