ATN NVG-7 2 YEAR PRODUCT WARRANTY, LIMITATION OF LIABILITY, PRODUCT WARRANTY REGISTR ATION, OBTAINING WARRANTY SERVICE

2 YEAR PRODUCT WARRANTY

This product is guarant eed to be fr ee from man ufacturing defects in material an d workmansh ip

under normal use for a period of 2 (two) years from the date of purchase. In the event a defect that

is covered by the foregoing warrant y occurs during the app licable period stat ed above, ATN, at its

option, will either repair or rep lace the product, and such action on the part of ATN shall be the full

extent of ATN’s liabi lity, and the Cu stomer’s sole a nd exclusive r emedy. This warr anty does no t

cover a product (a) used in other th an its normal and custom ary manner; (b) subje cted to misuse;

without prior written consent of ATN; (d) speci al order or “close-out” merc handise or merchandise

sold “as-is” by either ATN or the ATN dealer; or (e) merchandise that has been disc ontinued by the

manufacturer and either parts or replacement units are not available due to reasons beyond the con-

trol of ATN. ATN shall not be responsible for any defects or damage that in ATN’s opinion is a result

from the mishandling, abuse, misuse, improper storage or improper operation, including use in con-

junction with equipment which is elec trically or mechanicall y incompatible with or of inferior qualit y

to the product, as well as failure to maintain the environmental conditions specified by the manufac-

turer. CUSTOMER IS HE REBY NOTIFIE D THAT OPERATION OF TH E EQUIPMENT DU RING

DAYLIGHT HOURS OR UNDER ANY E XCESSIVE LIGHT CON DITIONS MAY PERMAN ENTLY

DAMAGE THE INTER NAL COMPON ENTS OF THE UN IT AND SAID DAM AGE WILL NOT BE

COVERED UNDER THIS WARR ANTY. This warranty is exte nded only to the origina l purchaser.

Any breach of this warranty shall be waived unless the cu stomer notifies ATN at the address noted

below within the applicable warranty period.

The customer understan ds and agrees that except for the foreg oing warranty, no other warrant ies

written or oral, statutory, expressed or implied, includ ing any implied warranty of merchantabilit y or

fitness for a particul ar purpose, shall appl y to the product. All such im plied warranties are he reby

and expressly disclaimed.

LIMITATION OF LIABILITY

ATN will not be liable for any claims, actions, suits, proc eedings, c osts, expe nses, damag es or

liabilities arising out of the use of this product. Operation and use of the product are the sole respon-

sibility of the Cus tomer. ATN’s sole underta king is limited to pr oviding the produ cts and servic es

outlined herein in accordance with the terms an d conditions o f this Agreement . The provision of

products sold and services per formed by ATN to the Customer shall not be interpreted, con strued,

or regarded, either expressly or implied, as being for the benefit of or creating any obligation toward

any third party of lega l entity outsid e ATN and the Customer; ATN’s oblig ations under thi s Agree-

ment extend solely to the Customer. ATN’s liabilit y hereunder for damag es, regardless of the

form or action, s hall not excee d the fees or ot her charges paid to ATN by the cus tomer or

customer’s de aler. ATN sha ll not, in any event, be liable for specia l, indirec t, incide ntal,

or consequenti al damages, in cluding, but not limited to, lost in come, lost reven ue, or lost

profit, whether such damages were foreseeable or not at the time of purchas e, and whether

or not such damages arise out of a bre ach of warranty, a breach of agr eement, neglig ence,

strict liability or any other theory of liability.

PRODUCT WARRANTY REGISTR ATION

In order to validate the warranty on your product, ATN must receive a compl eted Product Warranty

Registration Card for eac h unit. Plea se complete the form bel ow and immed iately mail it to our

Service Center: ATN Corporation, 20 South Linden Ave., Suite 1B, South San Francisco CA 94080.

Products qualifying for warranty repair will be either repaired or replaced within 10 business days of

receipt of merchandise unless the customer is notified otherw ise.

OBTAINING WARRANTY SERVICE

To obtain warranty service on your unit, take or send the product, postag e paid, with a copy of your

sales receipt to our service cen ter, ATN Corporation at the address noted above. All merc handise

must be fully insured with the correct postage; ATN will not be responsible for improper postage, or,
