LIMITATION: THIS WARRANTY DOES NOT COVER

1.As to CyberPower Products, this warranty does not cover or apply to : Misuse; modification; operation or storage damage or deterioration; improper operation or maintenance; use with items or equipment not designed or intended for use with the product.

2.As to the connected equipment, this warranty covers only damage within the specific terms of the Connected Equipment Guarantee to Connected Equipment (and only up to the applicable aggregate ceiling amount). The CyberPower Limited Warranty does not cover damage to Connected Equipment or apply if the product has been operated out of compliance with the instructions and manuals of its manufacturer/vendor.

This warranty does not apply unless the customer:

1.Has properly connected the Product and the Connected Equipment to properly wired and grounded outlets/power supplies (including compliance with electrical and safety codes of the most current National Electrical Code ANSI/NFPA 70), without the use of any adapters, extension cords, or other connectors.

2.Has provided a suitable and proper environment for use and installation of the Product and Connected Equipment.

3.Has properly installed and operated the CyberPower Surge Suppressor and the Connected Equipment.

CyberPower Connected Equipment Warranty

CyberPower warrants to the original purchaser of any CyberPower Surge Suppressor for the life of the product that the surge suppressor shall be free of defects in assembly, material, or workmanship, and will repair or replace, at its option, any defective product free of charge.

This connected Equipment Warranty is a Limited Warranty, subject to the limitations and exclusions set forth herein.

CyberPower Systems will repair or replace, at its option, any equipment which is damaged by transient voltage surge/spike or lightning strike (an “Occurrence”), while properly connected through a CyberPower Surge Suppressor to a properly wired AC power line with protective ground and telephone line properly connected.

Once CyberPower has determined that you are entitled to compensation, CyberPower will, at its option, pay you the present fair market value of the damaged equipment, or pay for the cost of the repair, up to the maximum amount set forth for your Surge Suppressor Model, or send to you the equivalent replacement equipment. The maximum amount of the warranty for your Surge Suppressor is shown on the product package, or can be found on CyberPower’s website at

www.cyberpowersystems.com.

The fair market value of the equipment shall be the current value of the equipment specified in the most

recent edition of Orion Blue Book, by Orion Research Corporation, Roger Rohrs Publisher, or a valuation as determined by CyberPower at CyberPower’s discretion.

CyberPower reserves the right to inspect the damaged CyberPower Surge Suppressor, the damaged equipment, and the site where the damage occurred. All costs of shipping the CyberPower Surge Suppressor and the damaged equipment to and from CyberPower for inspection shall be borne solely by the purchaser. CyberPower reserves the right to negotiate the cost and facility at which any repairs will take place, and CyberPower must be notified and approve of any repair facility before any connected equipment is serviced. Any repair or modification of the Connected Equipment or Surge Suppressor by a facility or entity not approved by CyberPower voids the warranty. If CyberPower determines, in its sole discretion, that it is impractical to ship the damaged equipment to CyberPower, CyberPower may designate, in its sole discretion, an equipment repair facility to inspect and estimate the cost to repair such equipment. The cost, if any, of shipping the equipment to and from such a repair facility and of such estimate shall be borne solely by the purchaser. Damaged equipment must remain available for inspection until the claim is finalized. Whenever claims are settled, CyberPower reserves the right to be subrogated under any existing insurance policies the claimant may have.

Standard CyberPower surge protectors are designed to eliminate disrupting and damaging effects of momentary (less than 1ms) voltage spikes or impulses from lightning or other power transients. If it can be shown that a voltage spike lasting longer than 1ms has occurred, the Occurrence will be deemed outside the rated capabilities of the surge suppressor and the warranty is void.

All above warranties are null and void if:

1.The CyberPower Surge Suppressor in use during the occurrence is not provided to CyberPower for inspection upon CyberPower’s request at the sole expense of the purchaser;

2.CyberPower determines that the CyberPower Surge Suppressor has been improperly installed, altered in any way, or tampered with;

3.CyberPower determines that the damage did not

result from the occurrence or that no occurrence in fact took place.

4.CyberPower determines that repair or replacement of the damaged equipment is covered under manufacturers warranty or any applicable extended warranties; or

5.CyberPower determines that the connected equipment was not used under normal operating conditions or in accordance with any labels or instructions.

All CyberPower Surge Suppressors must be connected directly into the power source and must not be “daisy-chained” together in serial fashion with other power strips, UPS, grounding adapters, other surge products or extension cords. Any such installation voids the warranty.

The CyberPower Connected Equipment Warranty only protects against damage to properly connected equipment where CyberPower has determined, in its sole discretion, that the Surge Suppressor did not function properly because it had defects in assembly, materials, or workmanship, causing it to operate outside design specifications, and the Surge Suppressor shows clear signs of damage, and the damage resulted from the Occurrence. The Connected Equipment Warranty does not protect against acts of God (other than lightning) such as, but not limited to, flood, earthquake, war, vandalism, theft, normal-use wear and tear, erosion, depletion, obsolescence, abuse, damage due to low voltage disturbances (i.e. brownouts, sags, or power outages), or system modification or alteration.

DO NOT USE FOR MEDICAL OR LIFE SUPPORT EQUIPMENT OR OTHER HIGH RISK ACTIVITIES.

CyberPower does not sell products for use in high-risk activities. CyberPower Surge Suppressors are not designed for use in hazardous environments requiring fail-safe performance, including the operation of nuclear facilities, aircraft navigation or communications systems, air traffic control, weapons systems, life support or medical applications or for use in any circumstance in which the failure of the product could lead directly to death, personal injury, or severe physical or property damage, or that would affect operation or safety of any medical or life support device (collectively, “High Risk Activities”). CyberPower expressly disclaims any express or implied warranty of fitness for High Risk Activities. CyberPower does not authorize use of any of its products in High Risk Activities. ANY SUCH USE IS

IMPROPER AND IS A MISUSE OF CYBERPOWER PRODUCTS.
