KIN end-user license agreement

This KIN End User License Agreement (the “Agreement”) is between you and Microsoft Corporation (“Microsoft”), One Microsoft Way, Redmond, Washington, USA, or, based on where you live, one of the Microsoft Corporation affiliates. Microsoft may be referred to as "we," "us" or "our". Please carefully read this Agreement before you use your wireless device (“Device”). Your use of the Device shall constitute your binding acceptance of all of the terms and conditions of this Agreement. If you do not agree to all of the terms and conditions of this Agreement, then you may not use the Device and should promptly return the Device to the place where you purchased it. This KIN Device has substantially different features than the features that were advertised when KIN devices were originally launched in the United States in May 2010. Specifically, this KIN Device is not supported by the KIN Service, which has been discontinued. The following features are not supported:

•The KIN Loop

•The KIN Spot

•The KIN Studio

•Feed reader

•Location-based services

•Web and “Near Me” Search

•Zune Pass streaming and download via mobile operator network

•Microsoft Exchange ActiveSync Email

•Integrated social networks and associated features

•Photo and video upload

•Server-side backup and storage of photos, videos, and contacts

•Account sync and automatic download and installation of software updates

•Help feature and website

By accepting this Agreement or using this KIN Device, you acknowledge and accept the change in features.

You may be prompted to accept additional contract terms that govern your installation and use of other software or services offered as a part of the KIN Device. If any terms of this Agreement conflict with the terms of any other contract for use of other software or services offered with the KIN Device, the terms of this Agreement shall apply. Microsoft reserves the right to change or modify any of the terms and conditions contained in this Agreement or any policy referenced herein at any time and in its sole discretion. You may access this Agreement at http://mobile.microsoft.com/Kin/en-US/ EULA.mspx. If we make a material change to this Agreement, then we will tell you at least 30 days
