10. Garantieerklärung für die SAMSUNG SSD Serie 830

Vielen Dank für den Kauf einer SAMSUNG Solid State Drive der Serie 830 (das "Produkt"). SAMSUNG schätzt Sie als Kunde und möchte Ihnen immer den bestmöglichen Service bieten.

LESEN SIE SICH VOR DER NUTZUNG DES DURCH SAMSUNG ELECTRONICS CO., LTD. ("SAMSUNG") BEREITGESTELLTEN PRODUKTS DIE FOLGENDEN ALLGEMEINEN GESCHÄFTSBEDINGUNGEN SORGFÄLTIG DURCH. DURCH VERWENDUNG DIESES PRODUKTS ERKLÄREN SIE SICH MIT DEN ALLGEMEINEN GESCHÄFTSBEDINGUNGEN DIESER GARANTIEERKLÄRUNG FÜR SAMSUNG SSD ("VEREINBARUNG") EINVERSTANDEN. WENN SIE DEN ALLGEMEINEN GESCHÄFTSBEDINGUNGEN DIESER VEREINBARUNG NICHT ZUSTIMMEN, DÜRFEN SIE DAS PRODUKT NICHT VERWENDEN.

A. Garantie- richtlinie SAMSUNG garantiert gegenüber dem ursprünglichen Endkunden oder Käufer dieses Produkts ("Ihnen"), dass dieses, gemäß den hierin genannten Bedingungen, frei von Material- und Herstellungsfehlern ist.

Sollte SAMSUNG in alleinigem Ermessen feststellen, dass das Produkt einen Material- oder Fabrikationsfehler aufweist und bei normaler Nutzung nicht wesentlich den veröffentlichten Spezifikationen entspricht, wird SAMSUNG, gemäß den in dieser Vereinbarung enthaltenen Bedingungen und Ausnahmen, nach seiner Wahl und solange Sie das Produkt besitzen, entweder: (1) das Produkt reparieren oder durch ein neues oder runderneuertes Produkt mit gleicher oder größerer Kapazität und Funktionalität ersetzen oder (2) Ihnen gemäß des Kreditplans in Abschnitt E dieser Vereinbarung einen Kredit gewähren, abzüglich gewährter Rabatte. SAMSUNG kann das Produkt im Falle eines Austauschs durch ein gebrauchtes, repariertes und auf Einhaltung der SAMSUNG Spezifikationen getestetes Produkt ersetzen. Diese Garantie wird ausschließlich Ihnen gewährt und ist nicht übertragbar. Möglicherweise ist die Vorlage eines Kaufnachweises erforderlich.

DIESE VEREINBARUNG BEINHALTET DIE GESAMTE HAFTUNG VON SAMSUNG UND IHR EXKLUSIVES RECHTSMITTEL IM FALLE EINES VERSTOSSES GEGEN DIESE VEREINBARUNG. SAMSUNG LEHNT ALLE SONSTIGEN AUSDRÜCKLICHEN UND STILLSCHWEIGENDEN GARANTIEN AB, EINSCHLIESSLICH (JEDOCH NICHT BESCHRÄNKT AUF) STILLSCHWEIGENDER GARANTIEN HINSICHTLICH ALLGEMEINER GEBRAUCHSTAUGLICHKEIT, EIGNUNG FÜR EINEN BESTIMMTEN ZWECK UND NICHTVERLETZUNG. UNTER KEINEN UMSTÄNDEN HAFTEN SAMSUNG, SEINE LIEFERANTEN ODER TOCHTERGESELLSCHAFTEN FÜR JEDWEDE INDIREKTEN ODER BESONDEREN SCHÄDEN, NEBEN- UND FOLGESCHÄDEN, VERMÖGENSSCHÄDEN SOWIE DATEN- ODER DATEIVERLUST, AUCH DANN NICHT, WENN SAMSUNG ÜBER DIE MÖGLICHKEIT SOLCHER SCHÄDEN INFORMIERT WURDE UND UNGEACHTET DESSEN, OB EINES DER EINGESCHRÄNKTEN RECHTSMITTEL SEINEN WESENTLICHEN ZWECK NICHT ERFÜLLT. UNTER KEINEN UMSTÄNDEN ÜBERSTEIGT DIE HAFTUNG VON SAMSUNG DEN VON IHNEN FÜR DAS PRODUKT GEZAHLTEN BETRAG. DIESE EINSCHRÄNKUNGEN UND AUSSCHLÜSSE GELTEN IM JEWEILIGEN GESETZLICH ZULÄSSIGEN RAHMEN.
