The software contained in the TicTalk phone and the software recorded
on the product CD (collectively, “Software”) together with the TicTalk
Quick Start Guide and the TicTalk Parent Guide (collectively, the
“Documentation”) are protected by U.S. copyright law and international
treaties, and may be used only in accordance with the terms and
conditions of this License Agreement (“Agreement”). Please carefully
read this Agreement before using the TicTalk phone. For purposes of
this Agreement, the term “you” or “your” refers to the parent(s) and/or
child(ren) who purchase and/or use the TicTalk phone. Using your
TicTalk phone indicates your unconditional acceptance of all of
the terms and conditions of this Agreement. (If you do not agree to
any term or condition in this Agreement, you should not use your
TicTalk phone but should instead return it to the merchant from whom it
was purchased, within the period specified by their product return
policy, to obtain a refund of your purchase price in accordance with
such policy.)
Ownership: Your TicTalk phone is supplied by Enfora, L.P. (“Enfora”).
Enfora or its licensors (as applicable) own all of the intellectual property
rights to the Software and Documentation (including any corrections,
revisions, updates, upgrades, enhancements or other modifications
thereto, and all copies or derivatives therefrom). The Software and
Documentation are not sold, but are licensed, to you as provided
below. There are no implied rights under this Agreement, and all rights
not expressly granted are reserved.
License: Subject to your compliance with all other provisions of this
Agreement, you shall have a non-exclusive license to use the Software
