12 assignment and change of ownership of phone

12.1For your security, we will not knowingly Re-connect a Phone owned by you to our Network at the request of someone other than you unless it is at least six months since you last Registered a pay as you go Voucher or the person requesting Re-connection is able to correctly identify your account password.

12.2We may assign our rights and obligations under these terms and conditions only if such assignment is on terms which are at least as advantageous as those set out herein.

13 liability

13.1Except as provided in this Condition 13, neither party shall be liable to the other, whether in contract or tort or otherwise, for any loss or damage which is:

13.1.1not the fault of the other party;

13.1.2indirect and/or not reasonably foreseeable.

13.1.3loss of business, profits, savings, revenue, use or goodwill whether caused to the other party

through any breach of your Contract or any matters arising under it.

Neither party excludes liability for negligent acts or omissions causing death or personal injury to any person.

13.2Subject to Condition 13.1, we limit our legal liability up to a maximum of three thousand pounds per claim or a series of related claims for any loss or damage which is:

13.2.1direct financial loss.

13.2.2direct physical damage to or loss of property resulting from our breach of contract or negligence while providing Services.
