4.Bayer HealthCare has no knowledge of the perform- ance of the Ascensia® CONTOUR ® Blood Glucose Meter when used with any test strips other than Ascensia MICROFILL Test Strips, and therefore makes no warran- ty of the performance of the Ascensia CONTOUR Meter when used with any test strips other than Ascensia MICROFILL Test Strips or when the Ascensia MICROFILL Test Strip is altered or modified in any manner.
BAYER HEALTHCARE MAKES NO OTHER EXPRESS WAR- RANTY FOR THIS PRODUCT. THE OPTION OF REPLACEMENT, DESCRIBED ABOVE, IS BAYER HEALTHCARE’S ONLY OBLI- GATION UNDER THIS WARRANTY.
IN NO EVENT SHALL BAYER BE LIABLE FOR INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, EVEN IF BAYER HEALTHCARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from state to state.
