Software License Agreement

Before using Network Viewer & Capture Software CD-ROM, thoroughly read the following software license agreement to fully understand its contents.

Use this CD-ROM only when you agree to the terms of this agreement.

If you do not agree to the terms, do not use this CD-ROM.

Software License Agreement

This is a legal agreement between the customer (hereafter referred to as "user") and Sanyo Electric. Co Ltd. (hereafter referred to as "our company"). Both parties accept the following terms on use of this software product (hereafter referred to as "software") that our company grants to the user the right to use the software.

Article 1 Definition of software

"Software" in this agreement includes computer software contained in this CD-ROM.

Article 2 Grant of license

Our company grants to the user the non-exclusive right to use the software on the following terms and conditions stated in this agreement.

Article 3 Duplication of software

The user may not duplicate all or a part of the software except that the user may make a copy of the software for backup purpose.

Article 4 Modification of software

The user may not decompile, disassemble, reverse engineer, or in any way modify the program code of the software.

Article 5 Proprietary right and copyright

All of the copyright and proprietary right of the software and its copies belong to our company.

Article 6 Prohibition of regrant and transfer of the license to any third party.

The user may not transfer the program or its copy to any third party without the express written permission from our company, or may not transfer or regrant the right to use the software.

Article 7 Contract term

This contract will commence on the date when the user starts using the software and shall be effective until the user finishes using the software.

However, our company shall have the right to deprive the user of the right to use the software and terminate the contract if the user is in the material breach of any term of this agreement.

Article 8 Obligations after contract termination

When the user terminates the contract, the user shall be responsible for making the software obsolete and dispose of it so that a third party cannot re-use it. The user shall also dispose of all duplicated or modified software and all documented materials about the software.

Article 9 Responsibilities of our company

In no event will company be liable to the user for direct, incidental or consequential damages, or other property damages, such as data and program damages, including any loss of profits or lost savings arising from use of the software made by the user.
