END-USER LICENSE AGREEMENT FOR EMBEDDED SOFT WARE
IMPORTANT – READ CAREFULLY: This License Agreement is a legal agree ment between you (either an individua l or an entity) and
Mitsubishi Digital Electronics America, Inc. (MDE A) for all software pre install ed and/or provided along with this televis ion (“Software”).
By utilizing this television and Software, you agree to be bound by the term s of this License Agreement.
The Software is protected by United States copyright laws and inter national treaty provisions, as we ll as other intellectual proper ty laws
and treaties. The Software is licensed, not sold.
1. LICENSE G RANT. MDEA grants you a non-exclusive, non -transferable, limited right and li cense to use one copy of the Software
only with the Mitsubishi television model that included this owner ’s guide and owned by you.
2. RIGHTS AND LIMITATIONS.
Software Not for Resale. You may not resell or otherwise transfer fo r value the Software, except in conjuncti on with a sale of the TV that
Software has been pre installed.
Prohibition on Reverse Engineering, Decompilation and Di sassembly. The Software contai ns trade secrets or other proprie tary material
in its human perceivable form and to protect them, you may not reverse eng ineer, decompile, or disassemble, or oth erwise reduce the
Software to any human perceivable form, except to the extent that the fore going restriction is expressl y prohibited by applicable law.
Separation of Components. The Software is license d as a single product. Its component p arts may not be separated for use on m ore
than one TV.
No Rental. You may not rent, lease, lend, or sublicense the Software.
Trademarks. This License Agreement does not grant you any rights to any trademarks o f MDEA.
3. VIOLATIONS. You understand that any use, copying or transfer of the Software, except a s permitted pursuant to this Lic ense,
may subject you to serious criminal and civil penalties includ ing damages and an award to MDEA of attor neys’ fees in connection with
any violation of this License. You further understand that you may be hel d legally responsible for any copyr ight infringement or other
violation of intellectual property rights that is caus ed, encouraged, or induced by your fa ilure to abide by the terms of the License. Thi s
license is effective until terminated, and will terminate immedi ately without notice from MDEA or ju dicial resolution if you fail to comply
with any provision of this License.
4. COPYRIGHT. All title and intellectual property r ights in and to the Softwar e (including but not limited to a ny images, photographs,
animations, video, audio, music, text, and “applets” incorporate d into the Software), and any accompanying p rinted materials are
owned by or licensed to MDEA. All title and intellectual prop erty rights in and to the content wh ich may be accessed through use of th e
Software is the property of the respective content owne r and may be protected by applicable co pyright or other intellectual prope rty
laws and treaties. This License Agreement grants you no right s to use such content, except that you own the media o n which the
Software is recorded, but MDEA and its licensors r etain ownership of the Software i tself. All rights not expressly gran ted are reserved
by MDEA.
5. EXPORT RESTRICTIONS. MDEA is licensing the Software for use within the United S tates. You agree that you will not export
or re-export the Software. You specifically agree not to expor t or re-export the Soft ware: (i) to any country to which the U.S. has
embargoed or restricted the export of goods or ser vices, which currently include, b ut are not necessarily limited to Cub a, Iran, Iraq,
Libya, North Korea, Sudan, and Syria, or to any national of any such c ountry, wherever located, who intends to tran smit or transport the
Software back to such country; (ii) to any person or entit y who you know or have reason to know will utilize the Sof tware in the design,
development, or production of nuclear, chemical, or biological wea pons; or (iii) to any person or entit y who has been prohibited from
participating in U.S. export transactions by any federal ag ency of the U.S. government. You warrant and repres ent that neither the BXA
nor any other U.S. federal agency has suspended, revoked, or denied you r export privileges.
6. DISCLAIMER OF WARRANTY. EXCEPT AS O THERWISE PROVIDED IN THI S LICENSE OR IN THE LIMITED WA RRANTY
APPLICABLE TO THE TV, MDEA MAKES NO OTHER WARRANT IES OF ANY KIND WHATSOEVE R REGARDING THE SOFT WARE
AND HEREBY EXPRESSLY DISCLAIMS ALL WARRAN TIES OF ANY KIND WHATSOEVE R, EXPRESS OR IMPLIE D, WITH
RESPECT TO THE SOFTWARE. ALL IMPLIED WARRA NTIES, INCLUDING, WI THOUT LIMITATION, THE IMPLIED WARRA NTIES
OF MERCHANTABILITY AND FITNESS FOR A PARTICULA R PURPOSE ARE HEREBY EX PRESSLY DISCLAIMED BY MDE A. IN
NO EVENT SHALL MDEA BE LIABLE TO YOU OR ANY THIRD PART IES, IN CONTRACT, IN TORT OR OTHERW ISE, FOR ANY
DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUE NTIAL DAMAGES OF ANY KIND O R NATURE. BECAUSE SOME
JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIM ITATION OF IMPLIED WARRANTIES, THE A BOVE LIMITATION MAY
NOT APPLY TO YOU.
7. LI MITATION OF LIABILITY. MDEA SHALL NOT, UNDE R ANY CIRCUMSTANCES BE LIABL E TO YOU OR ANY THIRD
PARTIES FOR ANY DAMAGES OF ANY NATURE, WHETHER INDI RECT, SPECIAL, INCIDENTAL, C ONSEQUENTIAL
OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, A NY CLAIMS FOR LOST PROFITS , LOSS OF GOOD WILL OR
EXPENDITURES MADE OR COMMITTED FOR IN R ELIANCE ON THE CONTINUATION OF T HIS LICENSE. YOU AGREE THAT
NEITHER MDEA’S BREACH OF THIS LICENSE NOR ITS FAI LURE TO REPAIR A DEFECT, ERROR OR BUG SH ALL CONSTITUTE
A FAILURE OF THE ESSENTIAL PURPOSE OF THIS LICE NSE. BECAUSE SOME JURI SDICTIONS DO NOT ALLOW THE
EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUEN TIAL OR INCIDENTAL DAMAGES, TH E ABOVE LIMITATIONS MAY
NOT APPLY TO YOU. MDEA’s liability to you for direct damages fo r any cause whatsoeve r and regardless of t he form of the
action, will be limited to the money p aid by you for the TV (bas ed on fair market value of t he TV) that cau sed the damages.
8. GENERAL. This License Agreement will be gove rned by the laws of the State of California.
