Thiswarranty extends only to the originaluser of the DISH Network
remotecontrol (“you,” “your”)and is lim ited tothepurchasepriceof
theremote control. EchoStarCommunications Corporation and its
affiliated companies (“w e,” “our,” “us”) warrant t his remote control
againstdefects in materialsor workmanship as follows.
Forone year from the original dateof purchase, if we find the remote
controlis defective subjectto the limits of this warranty,we will
replacethe remote atno charge for parts or labor.We warrantany such
workdone against defects in materialsor workmanship for the
remaining part of the origin al warranty period.
Thiswarranty does not cover installation of the DISH Network
System;consumer instruction;physical set up or adjustment of any
consumerelectronic device;remote control batteries; signalreception
problems;loss of use of the equipment;unused programming charges
dueto equipment malfunction; cosmeticdamage; damage due to
lightning,electricalor telephone line surges,fire, flood, or otheracts of
Nature;accident; misuse; abuse;repair or alteration by other than our
factoryservice; negligence;commercial or institutional use;improper
orneglected maintenance;equipment sold AS IS or WITH ALL
FAULTS;equipmentremoval or reinstallation; shippingdamage if the
equipmentwas not packedand shipped in the mannerwe prescribe; nor
equipmentpurchased, serviced,or operated outside the contiguous
UnitedStates of America.
REPLACEMENTAS PROVIDED UNDER THIS WARRANTY IS
YOUREXCLUSIVE REMEDY. WE SHALL NOT BE HELD
LIABLEFOR ANY INCIDENTAL OR CONSEQUENTIAL
DAMAGESFOR BREACH OF ANY EXPRESSED OR I MPLIED
WARRANTYON THIS DEVICE, NOR FOR ANY INCIDENTAL
ORCONSEQUENTIAL DAMAGE RESULTING FROM THE USE
OF,OR INABILITY TO USE, THIS DEVICE. UNDER NO
CIRCUMSTANCESSHALL OUR LIABILITY,IF ANY, EXCEED
