8. WARRANTY Limited Warranty

Exmark Mfg. Co. Inc. and its af filiate, Exmar k War r anty Company, pursuant to an ag r eement between

them, jointly warrant on the term s and condit ions her ein, that we will repair, replace or adjust any part

manuf act ur ed by Exmark and found by us (in the exercise of our r easonable discr etion) to be def ective

in fact or y mat er ial or work m anship.

This warranty is limit ed t o one year from t he date of original retail pur chase ( 90 days for rental use) for

any Exmark mower that is used for comm er cial or any other incom e producing purpose. The blade

spindle assemblies will be warranted for three years, one year parts and labor with an additional two

years parts only, from date of original r etail purchase against defects in materials or workmanship. The

fr am e and hydrost at ic t r act ion dr ive system, excluding hoses, will be warranted for two full years from

date of or iginal retail pur chase against def ect s in m aterials or workmanship. We will extend the

Peerless 5-speed tr ansm ission manufacturer ' s warrant y from 90 days to one year. Belts and tir es ar e

warranted for 90 days ag ainst defects in materials or workmanship.

The engine warrant y is covered by its respective engine m anufacturer. Please refer to the engine

manuf act ur ers warranty statement that is included in the liter at ure packet. We are not author ized to

handle warranty adjustments on engines. Engine warranties should be r eferred t o the nearest

authorized service outlet of the engine m anufacturer .

This warranty extends only to the original retail purchaser of the eq uipment. Th is warrant y may not be

assigned or t r ansferred without the prior express written consent of Exmark and Exmark Warranty

Company. The warranty period com m ences upon t he date of t he or iginal retail purchase.

The Exmark turf equipment, including any defective part, m ust be returned t o an aut hor ized Exmark

service dealer within the warranty period. The warranty shall extend to the expense of repair or

replacement ( as det ermined by us) of the defective part, including labor. T he warrant y shall not extend

to the expense of delivering the mower to the dealer for warranty work nor t he expense of returning it

back to the owner after r epair or replacement. O ur responsibility in respect t o claim s is lim ited to

making the required repairs or replacem ent s, and no claim of breach of warranty shall be cause for

cancellation or rescission of the contract of sale of any Exmark mower. Proof of pur chase may be

requir ed by the dealer t o substantiate any warranty claim. All warranty work m ust be performed by an

authorized Exmark service dealer.

This warranty extends only to turf equipment operated under normal conditions and properly serviced

and maintained. The warranty expressly does not cover: (i) any damage or deterioration due to

normal use, wear and tear , or exposure; (ii) norm al m aintenance services, such as oil change,

cleaning, lubr icat ion; adjustment ; (iii) replacement of service item s, such as oil, lubricants, spar k plugs,

or other it em s subject to norm al ser vice replacem ent ; (iv) damage or defects ar ising out of or r elating

to misuse, neglect, alter ation, neglig ence or accident ; (v) repair or r eplacem ent arising from operation

of or use of the tur f equipm ent which is not in accordance with operat ing instructions as specified in the

operator' s m anual or other operational inst r uct ions provided by Exmark; (vi) repair or replacement

arising as a r esult of any operation from tur f equipm ent that has been altered or m odified so as to, in

the determ inat ion of Exmark or Exmar k War r anty Company, adversely affect t he operation,

perf or m ance or durability of the equipment or t hat has altered, m odified or af fected the turf equipment

so as to change t he int ended use of the product ; (vii) repair or r eplacem ent necessitated by use of

parts, accessories or supplies, including gasoline, oil or lubricant s, incompatible with the turf equipm ent

or other t han as r ecom mended in the operator's manual or other oper ational instructions provided by

Exmark; ( viii) r epair s or replacements resulting from parts or accessor ies which have adversely

affected the oper at ion, performance or durability of the turf equipm ent ; or (ix) damage or defects due

to or arising out of r epair of turf equipm ent by person or persons other t han an aut horized Exmark

service dealer or the inst allat ion of parts ot her than genuine Exmark or Exmark r ecom mended parts.
