Mitsubishi TV Soft wareEND-USER LICENSE AGREEMENT FOR E MBEDDED SOFTWARE
IMPORTANT – READ CAREFULLY: This License Agree ment is a legal agreement betwe en you (either an individual or an entit y) and
Mitsubishi Digital Electronics A merica, Inc. (MDEA) for all sof tware pre installed and/or provi ded along with this television (“Sof tware”). By
utilizing this television and Software, yo u agree to be bound by the terms of this Licens e Agreement.
The Software is protected by United Sta tes copyright laws and international tr eaty provisions, as well as other intel lectual property laws
and treaties. The Software is lice nsed, not sold.
1. LICENSE GRANT. MDEA grants you a no n-exclusive, non-transferable, limi ted right and license to use one copy of the S oftware
only with the Mitsubishi television mode l that included this owner’s guide and owned by you.
2. RIGHTS AND LIMITATIONS.
Software Not for Resale. You may not resell or othe rwise transfer for value the Sof tware, except in conjunction with a sale of th e TV that
Software has been pre installe d.
Prohibition on Reverse Engineering, D ecompilation and Disassemb ly. The Software contains trade sec rets or other proprietary ma terial
in its human perceivable form and to protec t them, you may not reverse engineer, decompil e, or disassemble, or otherwis e reduce the
Software to any human perceivable for m, except to the extent that the foregoing restr iction is expressly prohibited by a pplicable law.
Separation of Components. The Sof tware is licensed as a single pro duct. Its component parts may n ot be separated for use on more
than one TV.
No Rental. You may not rent, lease, lend, or sublicen se the Software.
Trademarks. This License Agreement does not grant you a ny rights to any trademarks of MDEA .
3. VIOLATIONS. You understand that any use, copying or transfer of th e Software, except as permitted p ursuant to this License,
may subject you to serious criminal and ci vil penalties including damage s and an award to MDEA of attorneys’ fees in co nnection with any
violation of this License. You further under stand that you may be held legally res ponsible for any copyright infring ement or other violation
of intellectual property righ ts that is caused, encouraged, or in duced by your failure to abide by the terms of the L icense. This license
is effective until terminated, and will ter minate immediately without notice fro m MDEA or judicial resolution if you f ail to comply with any
provision of this License.
4. COPYRIGHT. All title and intellectual pr operty rights in and to t he Software (including but not limited to any images, ph otographs,
animations, video, audio, music, text, and “ap plets” incorporated into the Soft ware), and any accompanying printed mater ials are owned
by or licensed to MDEA. All title and in tellectual property rig hts in and to the content which may be access ed through use of the Software
is the property of the respecti ve content owner and may be protected by applic able copyright or other intellectu al property laws and
treaties. This License Agreeme nt grants you no rights to use such content, exc ept that you own the media on which the Soft ware is
recorded, but MDEA and its licen sors retain ownership of the Sof tware itself. All rights not express ly granted are reserved by MDEA .
5. EXPORT RESTRICTIONS. MDEA is licensing the Software fo r use within the United States. You agree that you will not
export or re-export the Sof tware. You specifically agree not to expor t or re-export the Soft ware: (i) to any country to which the U.S. has
embargoed or restricted the expor t of goods or services, whic h currently include, but are not nec essarily limited to Cuba, Iran, Ira q, Libya,
North Korea, Sudan, and Syria, or to a ny national of any such country, wherever loca ted, who intends to transmit or transpo rt the Software
back to such country; (ii) to any perso n or entity who you know or have reason to know will u tilize the Software in the design, develop ment,
or production of nuclear, chemical, or biolo gical weapons; or (iii) to any person o r entity who has been prohibited f rom participating in
U.S. export transactions by any federa l agency of the U.S. government. You warrant and repre sent that neither the BXA nor any othe r U.S.
federal agency has suspended, revoke d, or denied your export privileg es.
6. DISCLAIMER OF WARRANTY. EXCEPT AS OTHERWISE PROVI DED IN THIS LICENSE OR IN TH E LIMITED WARRANTY
APPLICABLE TO THE TV, MDEA MAKE S NO OTHER WARRANTIES OF AN Y KIND WHATSOEVER REGARD ING THE SOFTWARE
AND HEREBY EXPRESSLY DISCL AIMS ALL WARRANTIES OF A NY KIND WHATSOEVER, EX PRESS OR IMPLIED, WITH
RESPECT TO THE SOFTWARE. A LL IMPLIED WARRANTIES , INCLUDING, WITHOUT LIM ITATION, THE IMPLIED WARRANTIES
OF MERCHANTABILITY AND FITN ESS FOR A PARTICULAR PURPOS E ARE HEREBY EXPRESS LY DISCLAIMED BY MDEA. IN
NO EVENT SHALL MDEA BE LI ABLE TO YOU OR ANY THIRD PARTIES, IN C ONTRACT, IN TORT OR OTHERWISE, FO R ANY
DIRECT, INDIRECT, SPECIAL, INCI DENTAL OR CONSEQUENTIAL DAM AGES OF ANY KIND OR NATURE. BECAU SE SOME
JURISDICTIONS DO NOT ALLOW TH E EXCLUSION OR LIMITATION OF IMPLIED WARR ANTIES, THE ABOVE LIMI TATION MAY
NOT APPLY TO YOU.
7. LIMITATION OF LIABILITY. MDEA S HALL NOT, UNDER ANY CIRCUMS TANCES BE LIABLE TO YOU OR ANY THIRD
PARTIES FOR ANY DAMAGES OF ANY NATURE, W HETHER INDIRECT, SPECIAL , INCIDENTAL, CONSEQ UENTIAL OR
OTHERWISE, INCLUDING , BUT NOT LIMITED TO, ANY CLAI MS FOR LOST PROFITS, LOSS OF GOO D WILL OR EXPENDITURES
MADE OR COMMITTED FOR IN RE LIANCE ON THE CONTINUATION OF THI S LICENSE. YOU AGREE THAT NEITHE R MDEA’S
BREACH OF THIS LICENSE NOR I TS FAILURE TO REPAIR A DEFECT, ERROR OR BUG S HALL CONSTITUTE A FAILURE OF TH E
ESSENTIAL PURPOSE OF TH IS LICENSE. BECAUSE SOM E JURISDICTIONS DO NOT A LLOW THE EXCLUSION OR LIMITATION
OF LIABILITY FOR CONSEQU ENTIAL OR INCIDENTAL DAMAGE S, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. MDEA’s
liability to you for di rect damages for any ca use whatsoever and r egardless of the fo rm of the action, wil l be limited to the money
paid by you for the TV (bas ed on fair market value of t he TV) that cau sed the damages.
8. GENERAL. This License Agreement will be governed by the laws of the State of Cali fornia.
