Warranty information
ADC Kentrox warranties to Buyer that the products or services are free from sub-
stantial defects and workmanship under normal use given proper inst allat ion and
maintenance for the period of 60 months from the date of original shipment.
Buyer will promptly notify ADC Kentrox of any defect in the product or service.
ADC Kentrox or its agent will have the right to inspect the product or workmanship
on Buyer’s premises. ADC Kentrox has the option to (a) repair, replace or service at
its factory or on Buyer’s premises the product or workmanship fo und to b e defec-
tive; or (b) credit Buyer for the product or service in accordance with ADC Ken-
trox’s credit procedure. Refurbished material may be used to repair or replace the
product. Products returned to ADC Kentrox for repair, replacement, or credit will be
shipped prepaid by ADC Kentrox during the warranty period. Up on expiration of
the warranty, freight will be prepaid by the Buyer.
Limitation of warranty
ADC Kentrox assumes no warranty liability with respect to defects in the product
caused by: (a) modification, repair, installation, operation, or maintenance of the
product by anyone other than ADC Kentrox or its agent, except as described in ADC
Kentrox’s documentation; or (b) the negligent or other improper use of the product.
Other manufacturer’s equipment purchased by ADC Kentrox and resold to Buyer
will be limited to that manufacturer’s warranty. ADC Kentrox assumes no warranty
liability for other manufacturer’s equipment furnished by the Buyer.
No agent, distributor, or representative is authorized to make any warranties on
behalf of ADC Kentrox or to assume for ADC Kentrox any other liability in connec -
tion with any ADC Kentrox product or service.
The equipment may contain reconditioned parts, but those parts will be subject to
the same specifications and quality control standards we apply to new materials and
will be warranted as if they were new.
Disclaimer of warranty and limitation of remedies
BUYER UNDERSTANDS AND AGREES AS FOLLOWS:
■THE ABOVE WARRANTY REPLACES ALL OTHER WARRANTIES,
EXPRESSED OR IMPLIED, AND ALL OTHER OBLIGATIONS OR
LIABILITIES OF ADC KENTROX, INCLUDING ANY WARRANTIES
OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PUR-
POSE. ALL OTHER WARRANTIES ARE DISCLAIMED AND
EXCLUDED BY ADC KENTROX.
■THE FOREGOING WILL BE THE SOLE AND EXCLUSIVE REMEDY
WHETHER IN CONTRACT, TORT, OR O THERWISE AND
ADCKENTROX WILL NOT BE LIABLE FOR INJURIES OR DAM-
AGES TO PERSONS OR PROPERTY RESULTING FR OM ANY
CAUSE WHATSOEVER, WITH THE EXCEPTION OF INJURIES OR
