2nd month following the month of connection (approx. 3 months) and if migrated downwards (e.g. from 100 texts to 50 texts) then the difference in commission is clawed back

￿Any errors in commission payments can be reclaimed up to 12 months from date of connection.

￿Please note any customer that cancels within approximately 90 days of connection will have the price plan commission reclaimed.

￿T-Mobile reserve the right to clawback any commission paid to channel where in T-Mobiles sole discretion any activity on the account results in the commercial gain of either the customer or channel. This includes fraudulent activity and/or account/tariff consolidation.

￿Tariff discontinuation clawback - if a customer disconnects after 31 days but before the end of the 5th month following the month of connection (approx 6 months), then the tariff bonus is clawed back within 90 days.

With effect from 1st March 2004, for new connections, 3 reserve the right to clawback all commission payments (including price plan and volume bonuses) for disconnections due to fraud including non-payment since registration. However, where a valid proof has not been presented to, and accepted by 3 within 14 days of request, the commission clawback will be reversed in full. A full list of proofs are available from 3 Sellers website. 3 may clawback commissions up to 120 days after activation if the customer defaults on the payment of their bills. This decision for non payment is automated in 3’s systems through their collections team who have the hold on this decision.

Commission Reclaims -

Payment Terms on Avenir Telecom Invoice

Notwithstanding any prior arrangements that you may have reached with Avenir Telecom in respect of a credit account, any invoices issued to you by Avenir Telecom in respect of any commission reclaims from the airtime providers are due immediately upon presentation. If you do not make an immediate payment of the full amount claimed (including VAT) Avenir Telecom reserves the right to make immediate offset against any amounts that may be due from Avenir Telecom to you.

Avenir Telecom may receive incorrect information from the networks and will obviously reclaim any commission that has been paid in error. Never-pays may be deemed as fraudulent connections by the networks.

^The 120 days commences on the 1st day of the following month after connection.

#Price plan transfers will attract a commission reclaim if deemed for commercial gain.

Irrespective of stated Commission Reclaim terms Avenir Telecom reserves the right to reclaim any commission paid if any subsequent disconnection or price plan change has been made for the commercial gain of the Buyer or the end user.

*Customers cannot downgrade within the first 11 months on a 12 month contract, 15 months on an 18 month contract and 20 months on a 24 month contract.
