THROUGH YOUR PURCHASE OF THIS PRODUCT, ATEK, INC. GRANTS YOU A NONEXCLUSIVE LICENSE TO USE THE SOFTWARE CONTAINED WITHIN THE PRODUCT. Atek retainS all rights not expressly granted. USE of the software STARTS FROM THE FIRST TIME YOU TURN ON THE PRODUCT. This License does not constitute a sale and does not authorize a sale of thE SOFTWARE or anything created thereby. YOU MAY NOT MAKE ANY COPIES OF THE SOFTWARE WHETHER IN ELECTRONIC OR PRINT FORMAT. FURTHERMORE, YOU MAY NOT MODIFY, ADAPT, DISASSEMBLE, DECOMPILE, TRANSLATE, CREATE DERIVATIVE WORKS OF, OR IN ANY WAY REVERSE ENGINEER THE SOFTWARE except to the extent that this restriction is expressly prohibited by applicable law. You agree and certify that neither the software nor any other technical data received from Atek, inc. will be exported outside the United States except as authorized and as permitted by the laws and regulations of the United States. If you have rightfully obtained the software outside of the United States, you agree that you will not re-export the software nor any other technical data received from Atek, inc. except as permitted by the laws and regulations of the United States and the laws and regulations of the jurisdiction in which you obtained the software. YOU MAY NOT RENT OR LEASE THE SOFTWARE. THIS LICENSE IS EFFECTIVE UNTIL TERMINATED. by Atek, iNC. and is protected by United States laws and international treaty provisions. violation of these INTELLECTUAL PROPERTY OWNERSHIP rights AND THIS LICENSING AGREEMENT may be punishable by civil fines, criminal penalties, or both. If you are acquiring this product on behalf of another person or entity, you represent and warrant that you have the authority to bind the party or entity for which you are acquiring the product to the terms and conditions of this license agreement.

This license Agreement will be governed by and interpreted in accordance with the laws of the United States and the State of California without regard to or application of its choice of law rules or principles. If for any reason a court of competent jurisdiction finds any provision of this Agreement, or portion thereof, to be unenforceable, that provision of the Agreement shall be enforced to the maximum extent permissible so as to affect the intent

of the parties, and the remainder of this Agreement shall continue in full force and effect. This Agreement constitutes the entire agreement between Atek, INC. AND you with respect to the use of the Software IN this PRODUCt and supersedes all prior or contemporaneous understandings, communications or agreements, written or oral, regarding such subject matter. Atek, inc. may, in its sole discretion, modify portions of this Agreement at any time. atek, inc. may notify you of any changes by posting notice of such modifications

on ITS webSite(s) or sending notice via e-mail, postal mail or other means. your continued use of the Software in the product following notice of such modifications shall be deemed to be your acceptance of any such modifications
