5AGILENT TECHNOLOGIES WARRANTY STATEMENT

AGILENT PRODUCT: E1470A Cascade RF Switch Module DURATION OF WARRANTY: 3years

1.Agilent Technologies warrantsAgilent hardware, accessoriesand supplies against defects inmaterials and workmanship for the period

specifiedabove. IfAgilent receives notice of suchdefects during the warrantyperiod, Agilent will, at its option,either repair or replace

productswhich prove to be defective. Replacementproductsmay be either new or like-new.

2.Agilent warrants that Agilent softwarewill not fail to execute its programminginstructions, for the periodspecified above, due to

defectsin material and workmanshipwhen properly installed and used. IfAgilent receives noticeof such defects during the warranty

period,Agilent will replace softwaremedia which does not execute its programminginstructions due to such defects.

3.Agilent does not warrant thatthe operation of Agilent products will be interruptedor error free. IfAgilentis unable, within a reasonable

time,to repair or replace anyproduct to a condition as warranted,customer will be entitled toa refund of the purchase price uponprompt

returnof the product.

4.Agilent products may contain remanufacturedparts equivalent to new in performanceor may have been subject to incidentaluse.

5.The warranty period beginson the date of delivery or on thedate of installation if installedby Agilent. Ifcustomer schedulesor delays

Agilentinstallation more than 30 daysafter delivery, warranty beginson the 31st day from delivery.

6.Warranty does notapply to defects resultingfrom (a) improper orinadequate maintenanceor calibration, (b) software,interfacing,parts

orsupplies not supplied by Agilent, (c) unauthorizedmodification or misuse,(d) operation outside of the publishedenvironmental

specificationsfor the product,or (e) improper site preparation ormaintenance.

7. TO THE EXTENT ALLOWED BY LOCAL LAW, THE ABOVE WARRANTIES ARE EXCLUSIVE AND NO OTHER

WARRANTY OR CONDITION, WHETHER WRITTEN OR ORAL, IS EXPRESSED OR IMPLIED AND AGILENT

SPECIFICALLYDISCLAIMS ANY IMPLIEDWARRANTY OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY

QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE.

8.Agilent will be liablefor damage to tangibleproperty per incidentup to the greater of $300,000or the actual amountpaid for the product

thatis the subject of the claim, and for damagesfor bodily injury or death, to the extentthat all such damages are determinedby a court

ofcompetent jurisdiction to have beendirectly caused by a defective Agilentproduct.

9. TO THE EXTENT ALLOWED BY LOCAL LAW, THE REMEDIES IN THIS WARRANTY STATEMENT ARE CUSTOMER’S

SOLEAND EXLUSIVE REMEDIES. EXCEPTAS INDICATED ABOVE, IN NO EVENT WILL AGILENT OR ITS SUPPLIERS BE

LIABLEFOR LOSS OF DATA OR FOR DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOST PROFIT OR

DATA), OROTHER DAMAGE,WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE.

FORCONSUMER TRANSACTIONS IN AUSTRALIA AND NEW ZEALAND: THEWARRANTY TERMS CONTAINED IN THIS

STATEMENT,EXCEPT TO THE EXTENT LAWFULLY PERMITTED, DO NOT EXCLUDE, RESTRICT OR MODIFY AND ARE

IN ADDITION TO THE MANDATORY STATUTORY RIGHTS APPLICABLE TO THE SALE OF THIS PRODUCT TO YOU.
