Boost MobileTM Term s and Conditions of ServiceTERMS AND CONDITIONS OF PREPAID
SERVICE: PLEASE READ THESE TERMS AND
CONDITIONS CAREFULLY. THEY CONSTITUTE
A BINDING AGREEMENT (the “Agreement”)
BETWEEN YOU AND BOOST MOBILE.
You (“Customer”) accept the terms of this
Agreement (a) by calling to activate BOOST
MOBILESM wireless communications services
(“Service”), (b) by purchasing BOOST MOBILE
wireless communica ti on s eq uipment (the
“Equipment”) or Ser vice or replenishing yo ur airtime
through boostmobile.com, or (c) by signing this
Agreement, whichev er applies. By usin g the
Equipment, you subscribe to the Service provided
by Boost Mobile (sometim es “Company”). If you
have not signed a printed copy of this Agreement
and do not accept these terms, do not activate your
phone; you may return y our phone for a full refund ,
within 10 days of p urchase, to the retai l store where
you purchased it. Should there be any conflict
between the terms and conditions belo w, and the
terms and condition s of any applicable
Service/Subscriber Agreement between Customer
and Company covering the Equipment
accompanying the Activat ion Guide, the terms and
conditions of the th en-current applicable
Service/Subscriber Agreement will control. The
Service is provided to you through the Company as
agent for, and using the Digital Mobile Network (the
“System”) of, Nextel Communications, Inc. and its
affiliates and subsidiaries (collectiv ely, “Nextel”). All
rights and protecti ons afforded to the Company by
this Agreement are also affo rded to Nextel through
Nextel’s principal-ag ent relationship wi th the
Company.
1. SERVICE ACTIVATION - To act iva te th e Se rv ice
and the call credits in your BOOST MOBILE
Activation Guide, you must call our free automated
service number before the date shown. Remember
that by calling this numb er to activate your service,
you are agreeing to these Terms and Conditions of
Prepaid Service. By activating the Service you also
authorize Company to exchange with its related
business entities, contr ac tor s or ag en ts who ma y be
involved in providing the Service, any customer
information you may h ave pr ov id ed t o Comp an y t hat
is necessary for these related busine sses,
contractors, and entities to a ssist the Company in
providing the Servic e. Company may suspend or
cancel the Service at any time without no tic e if: (i)
there are reasonable grounds to suspect the
information provided by Custo mer to Boost Mobile
or its agent for user reg istration or when you
activated your Service, wa s incomplete or incorrect
or if there has been fraud or misuse by you in
