Boost MobileTM Terms and Con ditions of Service
5. CUSTOMER MOBILE DIGITAL EQUIPMENT –
Customer must have a Company approved handset
or device and must be a BOOST MO BILE Service
customer to access the Service. Company is not
responsible for the installation, operation, quality of
transmission, or maintenance of the Equipment.
Any change in Service or Equipment may require
additional programmin g or Equ ip me nt or ch ang es to
assigned codes or numbers that may require
programming fees. Company res erves the right to
change or remove assigned codes and/or numbers
when such change is reasonably necessary in the
conduct of its business. Customer does not have
any proprietary intere st in suc h co de s or nu mb er s .
Although Federal an d state laws may mak e it illegal
for third parties to listen in on service, complet e
privacy cannot be g uaranteed. Company shall not
be liable to Custom er or to any third pa rty for any
eavesdropping on or interception of com munications
from Company’s System.
6. RATES, CHARGES, AND PAYMENT – You will
be charged for your use of the Service in
accordance with th e terms of the BOOS T MOBILE
Rate Plan, as found in your BOOST MOBILE
handset kit or online at www.boostmobile.com. You
may request a copy of this document from Boost
Mobile at any time. Customer agrees to pay
Company, on a prep ay basis, for charges by
Company for the Ser vice. Customer ack nowledges
that chargeable time f or t e le phon e c al ls a nd BOO ST
Walkie-Talkie call t ransmissions origi nated by a
handset begins when a connection is established
with Company facilities. A new BOOST
Walkie-Talkie call is i nitiated by a call partici pant if
that participant responds more than six (6) seconds
after the other party finishes its BOOST MOBILETM
CONNECT transmission. Customer accepts
responsibility for Airtime charges from incoming
telephone calls to the handset f rom the time that
Customer responds to the call. Service charges
may apply to some service options when Customer
calls the BOOST MOBILETM Customer Service
number 1-888-BOOST- 4U ( 1-8 88 -266-7848). If
Customer disputes any Service charges, Customer
must submit a writ ten explanation wit hin forty five
(45) days from the date Co mpany debits Customer ’s
account for the dispu ted Service. If Comp any
determines that an error was m ade with respect to
any disputed Service ch arg es, C om pa ny shal l cred it
Customer’s account in the amount of the error. If
Customer does not pay the amount in dispute owed
to Company, Company ma y ex erc i se any remedies
it may have under this Agreement for non-payment
of Service charges. Company reserves the right to
modify any and all e lements of the Serv ice charges
at any time by giving notice of such changes to
Customer. If Custome r continues to use the Ser vice
after the Company ha s provided such no tice,
Customer will be deemed to have accepted the
changes, and such changes will be effective
