price. Any messages in excess of Customer’s
allotted messages will be charged at the per
message rate. Depending on the plan, Customer
may be charged o n a per kilobyte bas is (one
megabyte equals 1024 kilobytes and one kiloby te
equals 1024 bytes), for Cus to me r’s us e of W ire le ss
Data Services. Kilobytes may b e used for, without
limitation, browsin g the Internet, acc essing
Wireless Data Services an d for reading, sending
and responding to email. Airtime mi nutes allotted
to Customer under Customer’s wireless calling
plan may be used in conne ction with certain
Wireless Data Services. CUS TOMERS ARE
CHARGED AT LEAST ONE (1) MINUTE OF
AIRTIME FOR ALL WIRELESS CALL S AND AT
LEAST SIX (6) SECONDS OF AIRTIME FOR ALL
DIRECT CONNECT® TRANSMISSIONS,
REGARDLESS OF LENGTH. AFTER THE
INITIAL MINUTE, AIRTIME CHAR GES FOR
WIRELESS CALLING ARE ROUNDED-UP AND
BILLED TO THE NEXT SECOND OR TO THE
NEXT MINUTE, DEPENDING ON CUSTOMER’S
SERVICE PLAN. AFTER SIX (6) SECOND S,
DIRECT CONNECT® TRANSMISSIONS ARE
ROUNDED-UP AND BILLED TO THE NEXT
SECOND. DATA USAGE FOR WIRELESS DATA
SERVICES IS ROUNDED TO THE NEAREST
ONE-TENTH (1/10) OF A KILOBYTE.
Taxes, Fees and Assessments - Customer shall
pay all federal, state, and local taxes and fees that
are imposed on transa ctions subject to this
Agreement. Custo mer shall not be resp onsible for
taxes and fees imposed on Nextel’s net income or
property. Custom er shall be respons ible for all
taxes and fees (whether imposed upon Customer
or Nextel) that are measu red by gross receipts
from sales made to Customer or imposed as a
per-line or per-unit char ge. Applicable taxes and
fees include, but are not limited to, the follow in g:
federal, state, and local excise taxes, sales and
transaction taxes, gross r eceipts taxes, utility
taxes, and statutory 911 fees. If Customer is
eligible for an exempt ion from any tax or fee,
Customer must provide Ne xtel with a valid and
properly executed exemption certificate for the
exemption to be effective. Customer shall provide
Nextel with the Pri mary Place of Use (i .e.,
Customer’s resi dential street addre ss or primary
business address) for each unit activated on
Customer’s account, an d notify Nextel of any
changes in such address. Additional fees and
assessments apply to Customer’s monthly Service
Plan. The charges may change and may vary
