underthis Agreement;(2) Customer behavesin an
abusive, derogatory, o r otherwise unreason able
manner to any Nextel employee, representat ive or
agent;(3) Nextel has reasonto believe that
Customer's Service is being us ed in a fraudulent
manneror for an illegal purpose(such as unusual
activitylevels or callingpatterns); (4) Customer's
Serviceis being usedin a way that adversely
affectsother Customers' Serviceor Nextel's
business operations; ( 5) Customer provide s Credit
Information that is fals e, inaccurate, dat ed or
cannotbe verified or Customerbecomes insolvent
orsu bject to any proceeding un der the Bankruptcy
Codeor similar laws; (6)Nextel discovers that
Customeris underage or doesnot otherwise
possessthe capacity or theauthorization to enter
into this Agreement; (7) C ustomer's use of the
Service or Equipment exceeds l imitations or
violatesany restrictionsplaced on Customer's
account or otherwise breach es this Agreement; or
(8) N extel, in its sole discretion, belie ves action is
requiredto protect itsinterests or the interestsof
Customer or its other customer s.N EXTEL SHALL
NOTBE LIABLE TO CUS TOMER OR TO ANY
OTHERPARTY FOR EXERCISING OR FA ILING
TOEXER CISE ITSRIGHTS UNDER THIS
SECTIONTO LIMIT, SUSPEND OR T ERMINATE
SERVICEOR THE AGREEMENT.If Cu stomer's
Serviceis subject to fraudulentuse, Customer
shallimmediately notifyNextel's Customer Care
department,provide Nextelwith any
documentationandinformation thatit requests and
otherwise cooperate with Ne xtel in the
investigation of such incident. I f Nextel terminates
ServicetoCustomer,andServiceisnot
reconnected within thir ty (30) calendar days, a ll
amountsowed to Nextel (includingany damages
forearly termination)shall become immediately
dueand payable.
Reactivation - Nextel may, but is n ot required to,
reactivate Service to Customer a fter Service has
beensuspended or terminatedin accordance with
thepre vious subsection. Before Service may be
reactivated, Customer mu st pay to Nextel all past
dueamounts plus a reconnectioncharge equal to
$25.00per Number, plus applicabletaxes. Nextel
maymodify the terms of Service before
reactivatingServiceto Customer and may require
Customer to provide Nextel wi th an initial Deposit
oran additional Deposit.
11.R ELEASE OF CUSTOMER INFORMATION -
Privacy - Wireless systems use rad io channels to
transmitcommunicationsthat may be accidentally
orintentionally intercepted.Although federaland
statelaws may make it illegalfor third parties to
listenin on Customer's Service,privacy cannot be
guaranteed.NEXTEL SHALLNOT BE LIABLE TO
